Judge drops Broad Ripple bar case after ‘unconstitutional’ search from Prosecutor Mears
A Marion County judge dismissed the 27-felony tax case against Broad Ripple bar owner Robert Sabatini. The local business owner in Broad Ripple was the subject of intense, inappropriate scrutiny from the prosecutor’s office following a shooting in 2023.
Judge Clark Rogers characterized the Prosecutor Mears’s conduct as a “baseless search” and “official snooping” that was unconstitutional and lacked suspicion. Judge Rogers dismissed the charge with prejudice, meaning they cannot be refiled. Read more in the Indy Star.
“Without any doubt, the Marion County Prosecutor conducted a warrantless search that violated the 4th amendment,” Judge Rogers said.
Marion County citizens deserve a prosecutor who doesn’t step over the lines of the law to further his own agenda while ignoring corruption in government offices.
